Terms and Conditions

I. Rates

  1. All publish rates are subject to 21% tax & service charge.

  2. Contract rates are quoted net in IDR.

  3. All rates are not including gratuities, telephone, meals, cars and drivers.

  4. Maximum persons stay in villa is 2 per room.

II. Benefits

  1. One night stay in Villa with private pool

  2. Daily hospitality services.

  3. Welcome drink & chilled towel upon arrival.

  4. Complimentary wireless internet for 24 hours.

  5. Complimentary mineral Water

III. Season and Extra Bed Charges

  1. Low Season: January 6th to June 30th, September 1st to December 19th.

  2. High Season: July 1st to August 31st.

  3. Peak Season: December 20th to January 5th.

  4. Extra Person: IDR., - per night (exclude breakfast).

  5. Extra Bed: IDR., - / Bed / Night for Adult (12 years above, exclude Breakfast)

  6. Minimum Booking

    1. Low Season: 2 Nights

    2. High Season: 3 Nights

    3. Peak Season: 5 Nights

IV. Children

Children under 6 years old are FOC share bed with their parents.

V. Check-in & Check-out Times

  1. Check in time is after 2pm.

  2. Check out time is 12pm.

  3. Late check out until 18:00 is charged 50% from the existing contract rate and after 18:00 consider a full night charge applied unless prior notice is negotiated.

  4. Early check in and late checkout are subject to space availability and prior notification is requested.

VI. Day Use

For day use 50 % charge of contracted rate for late check out – until 18:00 based on availability.

VII. Villa Voucher

A valid voucher is required prior to guest’s arrival or upon guest’s check in. Failure to provide a valid voucher before guest’s departure will be automatically switched to normal publish rate and payment will be on guest personal account.

VIII. Payments and Cancellations

  1. A deposit of 50% of the rental amount must be transferred on receiving confirmation of reservation.

  2. Final payment is required 30 days prior to arrival or immediately if booking is made less than 30 days prior to arrival in order to guarantee your reservation.

  3. Cancelation:

    1. 50 % cancellation fee from the total room night reserved will be charged if any cancellation received 21 - 8 days prior arrival on high or peak season and 14 - 8 day on low seasons,

    2. 100 % cancellation fee from the total room night reserved will be charged if any cancellation received 7 - 0 days prior arrival or in case of NO SHOW.

  4. Payment can be made by credit card (Visa/Master/Amex) or telegraphic bank transfer, the amount transferred must include telegraphic transfer fees.

  5. No large party or function will take place at REV Collection without prior notification and approval.

  6. The villa disclaims any and all liability of property loss or damage, as well as injury including death sustained by any person whilst residing at the villa or while engaged on any tour whether the loss or injury occurs as a result of breach of contractual obligations of the villa, it’s staff, employees or agent.

IX. Events and Parties

  1. No large party or function will take place at Khaya Luxury Villas without prior notification and approval.

  2. Villa has rules governing their usage for events and parties and at times a surcharge is applicable (plus the local community or ‘Banjar’ fee if any). Guests must be respect and abide by Villa and Banjar regulations (i.e. curfews and noise limits)

  3. If your clients are planning to hold an event such as a wedding or any large congregation of people at the villa, it must be informed to Khaya Luxury Villas management in advance.

X. Function Fees

If your client is planning to hold an event such as a wedding or any large congregation of people at a villa, please inform Khaya Luxury Villas management in advance for the event guidelines.

XI. Force Majeure

  1. The villa disclaims any and all liability of property loss or damage, as well as injury including death sustained by any person whilst residing at the villa or while engaged on any tour whether the loss or injury occurs as a result of breach of contractual obligations of the villa, its staff, employees or agent.

  2. Neither party shall be liable to the other for any failure to perform any obligations under this Agreement due to causes which are beyond their reasonable control and of a nature which neither has the power to remedy, including without limitation, acts of God, acts of civil or military disturbances, fire, floods, epidemic, wars, riots and acts of terrorism. In the event of such occurrence, the party claiming relief thereon shall give prompt written notice thereof to the other party and any time of an obligation shall be extended by time equal to the length of delay attributable to such occurrence.

XII. Confidential and Exclusivity

  1. This contract remains confidential between the undersigned and designates clientele and shall not be disclosed to other third parties. Unauthorized disclosure of content will automatically terminate this agreement.

  2. Any amendment to this agreement shall not be valid until agreed in writing by authorized.

  3. Internet restriction, in the event travel agent decides to use internet as a medium of promotion, Villa must be notified in advance for approval. Contract Rate is not valid for internet promotions.

XIII. General Conditions

Khaya Luxury Villas and ___________ agree to each carry adequate liability and other insurance protecting itself against any claims arising from any activities conducted in the retreat during the period of accommodation. The performance of the agreement by either party is subject to acts of nature, war, government regulations, disaster, strikes, civil disorder, curtailment of transportation facilities, or any other emergency making it illegal or impossible to provide the facilities contracted.

XIV. Contract Expiration

This agreement is valid immediately until ____________. Khaya Luxury Villas reserves all rights to terminate the agreement one month before the expiration date base on our professional consideration. It is understood that this contract rate is considered valid for further activation when signed by both parties and signed copy is received by Khaya Luxury Villas by email to _____________________________.
